CNMC questions new green rules for data centres

Spain's competition watchdog warns that proposed clean energy mandates for data centres could hinder growth ahead of the 2030 targets.

The CNMC, led by Juan José Ganuza, has issued a report questioning new requirements for data centres proposed by Sara Aagesen’s Ministry for the Ecological Transition. The draft regulation mandates that 80% of hourly consumption be backed by clean energy.

Spain has granted 12,000 MW in permits, with 27,000 MW pending, yet 32,000 MW in applications were denied. The CNMC suggests a progressive rollout until 2030 to mitigate impact, as non-compliance faces surcharges of up to 500% on electricity tolls and charges.

The consultative report arrives ahead of the November 29 elections. While the AI Strategy targets 2,500 MW by 2030, recent measures have seen promoters renounce 1,600 MW of capacity. Trade body Spain DC, representing firms like Amazon, remains concerned.
