The High Court of Justice of the Valencian Community has ordered health authorities to pay 100,000 euros to the family of Marta Pérez. The 19-year-old from Ibi entered a state of unresponsive wakefulness after a pistachio allergy triggered a cardiac arrest in 2022.
Judges ruled that a deficiency in healthcare assistance occurred when the patient was sent home instead of being observed for biphasic anaphylaxis. The court found the initial medical assessment was insufficient and failed to record vital patient history details.
While the family sought 4.1 million euros, the court awarded the lower sum for moral damages under the loss of opportunity doctrine. This ruling is not final and remains subject to appeal at the Supreme Court, with no procedural costs imposed on either party.
