Court orders repayment of Asturias social salary

The Superior Court of Justice of Asturias rules that regional social salary is incompatible with the state-managed Minimum Vital Income.

The has ordered a woman to repay 16,365.93 euros to the regional administration. This follows a ruling by the Social Court of Oviedo, which confirmed that the regional social salary and state income are incompatible.

The claimant received regional benefits from 2015, reaching 461.73 euros monthly by 2023. After being granted the state-managed retroactively from 2020, she received over 20,000 euros, leading to the termination of her regional support.

Under the 2005 Basic Social Salary Law, regional aid is strictly subsidiary and complementary. This case reinforces the legal requirement that state subsidies take precedence, ensuring beneficiaries do not receive double payments for the same period.
