The Spanish State Attorney's Office has appealed the Supreme Court's decision to halt the registration of certain descendants of exiles in the Electoral Census of Absent Residents. This appeal challenges precautionary measures that currently block voting rights.
The legal dispute follows challenges by Iustitia Europa and Vox against the Central Electoral Board. While the Supreme Court's provisional suspension does not annul nationalities, it prevents new registrations under the 2022 instruction from having electoral effects.
State attorneys argue the suspension is excessive, noting the 2022 instruction is final and poses no census risk. The measure remains until a final judgment, though it excludes those with consular certification proving their ancestors suffered political exile.
