The Supreme Court has admitted an appeal by Madrid City Council against rulings that annulled the 2025 garbage tax. The Superior Court of Justice of Madrid previously voided the levy due to defects, including the failure to publish a full technical report.
Judges will now determine if publishing technical-economic reports is sufficient or if further methodologies must be disclosed. Over 130,000 people have already claimed against the tax, which generates approximately 300 million euros in annual revenue.
Mayor José Luis Martínez-Almeida stated refunds will only apply to those who appealed in a timely manner. While the 2026 ordinance is also facing legal challenges, citizens have a 30-day window to appeal current tax notifications following municipal receipt.
